Common Questions

What is the purpose of the Alabama Mvt 20 1 form?

The Alabama Mvt 20 1 form is used to apply for a certificate of title to record or transfer a lien on a vehicle. What information is required to complete the form?

You will need to provide detailed information about the vehicle, including its Vehicle Identification Number (VIN), make, model, year, and current title number. Misconceptions

Understanding the Alabama Mvt 20 1 form can be tricky, and several misconceptions often arise. Here are eight common misunderstandings about this form, along with clarifications to help you navigate the process more easily.

  • This form is for transferring ownership of a vehicle. This is incorrect. The Mvt 20 1 form is specifically designed to record or transfer a lien only, not to transfer ownership.
  • Anyone can use this form. Not true. Only lienholders can use this form. If you're a designated agent, you need to use a different form, specifically the MVT 5-1E.
  • You can submit this form without the current Alabama title. This is a misconception. You must include the current Alabama title with your application when using the Mvt 20 1 form.
  • The form can be filled out in any way. Actually, the form must be typed or printed legibly. Illegible forms will be returned, causing delays.
  • There's no fee associated with this application. This is false. A non-refundable application processing fee of $15 is required, payable in certified funds only.
  • Any vehicle can be recorded using this form. This is misleading. Certain vehicles are exempt from titling based on their age or type, such as those over 35 model years old.
  • All information can be changed on the form. Incorrect. The owner information must match the details on the surrendered Alabama title, except for current mailing and resident addresses.
  • You can use personal checks or cash to pay the fee. This is not allowed. Only certified funds can be accepted for the application fee.

This form may not be used on a transfer of ownership or by designated agents. Designated agents shall use form MVT 5-1E to record liens.

Exemptions

(1)Effective January 1, 2012, no certificate of title shall be issued for any manufactured homes, trail- er, semi-trailer, travel trailer, or folding or collapsible camping trailer more than twenty (20) model years old. This exemption is applicable on January 1 of each year and applies to all manufactured homes, trailers, semi-trailers, travel trailers, and folding or collapsible camping trailers with a model year, as designated by the manufacturer, older than twenty (20) years from the current cal- endar year. All utility trailers, other than folding or collapsible camping trailers, are still exempt from titling regardless of the year model.

Example: As of January 1, 2012, all 1991 and prior year model manufactured homes, trailers, semi-trailers, travel trailers, and folding or collapsible camping trailers are exempt from the titling provisions of Chapter 8, Title 32, Code of Alabama 1975.

(2)Effective January 1, 2012, no certificate of title shall be issued for any motor vehicle more than thirty-five (35) model years old. This exemption is applicable on January 1 of each year and applies to all motor vehicles with a model year, as designated by the manufacturer, older than thir- ty-five (35) years from the current calendar year.

Example: As of January 1, 2012, all 1976 and prior year model motor vehicles are exempt from the titling provisions of Chapter 8, Title 32, Code of Alabama 1975.

(3)Effective January 1, 2012, no certificate of title shall be issued for a low speed vehicle. A low speed vehicle is defined as a four-wheeled motor vehicle with a top speed of not greater than 25 miles per hour, a gross vehicle weight rating (GVWR) of which is less than 3,000 pounds and complying with the safety standards provided in 49 C.F.R. Section 571.500. The term includes neighborhood electric vehicles.

NOTE: The exemption from titling does not invalidate any Alabama certificate of title that is currently in effect. However, no subsequent title, including a certificate of title to record or transfer a lien, can be issued if the vehicle is exempt from titling.

Common mistakes

  1. Illegible handwriting: Many people fill out the form by hand, but if the writing is hard to read, the form may be returned. Always print clearly or type the information.

  2. Incorrect vehicle identification number (VIN): The VIN must match exactly with the one on the current Alabama title. A small mistake can lead to delays or rejections.

  3. Missing required signatures: All necessary parties must sign the form. If even one signature is missing, the application may not be processed.

  4. Not including the title fee: The application requires a $15 fee in certified funds. Forgetting to include this payment can cause the application to be delayed.

  5. Inaccurate owner information: The owner’s name and address must match what is on the surrendered Alabama title. Any discrepancies can lead to complications.

  6. Not following instructions: The form has specific instructions that must be followed. Ignoring these can result in the form being returned for corrections.

  7. Failing to check for exemptions: Some vehicles may be exempt from titling. If you submit the form for an exempt vehicle, it will be rejected.
